QUALIFICATION FOR STIMULUS PAYMENTS (PERMANENT RESIDENT THROUGH ASYLUM, ASYLEES & ASYLUM SEEKERS) | EAD APPLICATION DURING THE OUTBREAK



The economic disaster caused by the CoronaVirus Pandemic is severe and crippling as a result, Congress has passed a $2.2 trillion aid package here in the United States of America. 

To qualify for the payment, you must be a U.S. citizen or a lawful permanent resident (commonly referred to as a Green Card holder). Others who legally reside in the United States such as asylees and asylum seekers, may also be eligible for the payment, as long as they are not "non-resident aliens, by the IRS, Internal Revenue Service. If you do qualify, you should not have to do anything to receive the payment, it should be credited to your account or mail directly to you. 

This is a reminder that the payment is dependent on your income levels as indicated in the Washington Post: 

Individuals with adjusted gross incomes up to $75,000 a year will be eligible for the full $1,200.00 cheque. Reduced cheques will go out to individuals making up to $99,000 a year (the payment amount falls by $5.00 for every $100.00 in income above $75,000). Married couples are eligible for a $2,400.00 cheque as long as their adjusted gross income is under $15,000.00 a year. Reduced cheques on a sliding scale, will go out to married couples who earn up to $198,000. Married couples also will receive an additional $500 for every child under 17. 

People who filed as "head of household" (typically single parents with children) are eligible for a $1,200.00 cheque if they have an adjusted gross income up to $112,500 a year. Reduced cheques on a sliding scale are available for heads of household earning up to $136,500.00 annually. Heads of household will also receive an additional $500 per child under 17. 

Assuming you qualify for the payment based on your income, you must also have a valid Social Security number. For married couples, it seems both spouses must have Social Security Numbers. According to the Tax Policy Center, "If one spouse has a Social Security number, but the other does not, the couple is ineligible for the payment (there is an exception for military families).

The IRS, Internal Revenue Service expects to start sending an initial wave of economic stimulus payments, worth up to $1,200.00 apiece, to some 60 million Americans the week of April 13, Treasury Department and IRS officials have told the House Ways and Means Committee. 

EXTENSION OF EMPLOYMENT AUTHORIZATION DOCUMENTS 

Applicants to the United States Citizenship and Immigration Services, USCIS who had an appointment scheduled with an ASC after their closure on March 18, 2020 or who have filed a Form I-765, Application for Employment Authorization, extension will have their application processed using previously submitted biometrics. This announcement is consistent with existing USCIS authorities regarding the agency's ability to reuse previously submitted biometrics. This will remain in effect until ASCs resume normal operations.

ASYLEES AND THE RIGHT TO WORK!

If you are an ASYLEE (ASYLUM GRANTED) , you do NOT   require an EAD, Employment Authorization Document to work in the United States.  Let's discuss the law, In the HANDBOOK FOR EMPLOYERS M-274 on USCIS, United States Citizenship and Immigration Services website SECTION 6.3 REFUGEES AND ASYLEES.  Refugees and asylees are AUTHORIZED   to work indefinitely because of their immigration status does not expire.  After being granted ASYLUM in the United States, The Department of Homeland Security issues a FORM I-94, ARRIVAL/DEPARTURE RECORD , to asylees. FORM I-94 will contain a stamp or natation such as "ASYLUM GRANTED INDEFINITELY" or the appropriate provision of the law (8 CFR 274.a.12(a)(5) or INA 208) to show their employment authorization.
