ASYLEES TRAVELLING WITH A PENDING ADJUSTMENT OF STATUS APPLICATION (FORM I-485)

If you were admitted as a refugee or granted asylum (asylee) and are applying for adjustment of status (Form I-485) one year after that, you can travel outside the United States on a valid U.S. Refugee Travel Document (Form I-571)and don't have to apply for an Advance Parole.

Page 17 of Form I-485, Application to Register Permanent Residence or Adjust Status indicates that Asylees only need a U.S. Refugee Travel Document while their application is pending with the United States Citizenship and Immigration Service. ASYLEES DON'T NEED AN ADVANCE PAROLE, ONLY A U.S. REFUGEE TRAVEL DOCUMENT WITH A PENDING FORM I-485.

Asylees adjustment of status is under Immigration and Nationality Act Section 209 because you were admitted as a refugee or granted asylum (asylee), you may travel abroad and return to the United States with a refugee travel document.

You may obtain a refugee travel document by filing Form I-131 as specified in the Form I-131 Instructions. However, see Form I-131 Instructions for a travel warning regarding voluntary re-availment. 




A refugee or asylee (or family member with refugee or asylee status) who is not a Legal Permanent Resident and who plans to depart the United States for any period of time and is seeking permission to reenter the U.S. as a refugee after travel outside the United States, must apply to the United States Citizenship and Immigration Services for the Refugee Travel Document and be issued the Refugee Travel Document prior to departure from the U.S. 

The refugee or the asylee should keep the Refugee Travel Document with him/herself at all times during the trip outside the U.S. Refugees with a pending Form I-485 may travel outside the U.S. with their Refugee Travel Document. The Refugee Travel Document does not distinguish between refugee and asylee.

ASYLEES AND THE RIGHT TO WORK!

If you are an ASYLEE (ASYLUM GRANTED) , you do NOT   require an EAD, Employment Authorization Document to work in the United States.  Let's discuss the law, In the HANDBOOK FOR EMPLOYERS M-274 on USCIS, United States Citizenship and Immigration Services website SECTION 6.3 REFUGEES AND ASYLEES.  Refugees and asylees are AUTHORIZED   to work indefinitely because of their immigration status does not expire.  After being granted ASYLUM in the United States, The Department of Homeland Security issues a FORM I-94, ARRIVAL/DEPARTURE RECORD , to asylees. U.S. REFUGEE TRAVEL DOCUMENT WITH NEW ENHANCED SECURITY FEATURES To prevent secure document tampering, counterfeiting, and fraud, The United States Citizenship and Immigration Services (USCIS) will begin producing a new security-enhanced U.S. Refugee Travel Document effective October 24, 2019.
